Welcome to capsule colliders our IOS mobile application (our “Game”). This Privacy Policy applies to you and Matthew Gleason of New Lenox, Will County, Illinois, USA, (“we”, “us”, or “our”) irrespective of your country of residence or location.

 

With the help of this Privacy Policy, we inform you comprehensively about the processing of your Personal Information by us and the rights to which you are entitled.

 

We are acting as the Data Controller in accordance with the Illinois Personal Information Protection Act (“PIPA”) and of course, the General Data Protection Regulation (“GDPR”).

When designing the Game, we have made sure that as little as possible information that directly identifies you is collected. As however some countries including the European Union, have a broad definition of Personal Information, this policy covers it.

In this sense we would need to first explore the definition of Personal Information.

Personal Information is information that makes it possible to identify a natural person. This includes, your name, date of birth, address, telephone number, e-mail address, but also your IP address or Device Identifiers.

Relevant legal basis

In accordance with the PIPA and GDPR, the following legal basis, unless specifically described below apply to the processing of your Personal Information:

 

  • consent,

  • to fulfill our services and carry out contractual obligations,

  • to fulfill our legal obligations, and

  • to protect our legitimate interests.

 

Processing of Personal Information

Personal Information may be collected in two ways, that is directly when you for example volunteer it to us or automatically for example when you install and use our Game. As indicated above we have made sure that as little as possible information that directly identifies you is collected.

 

If you contact us, the Personal Information you transmit may include your Name, your email address and of course the content of your message. We will process the data you submit for the purpose of processing your request and replying to you. Of course, we delete the data as soon as it is no longer required for the processing of your request. The legal basis for processing is your consent, our legitimate interest in providing support and/or a contractual or precontractual measure.

 

Automatically collected data

The Game can be downloaded from the "Apple App Store" and you might be required to register with Apple and/or to download certain App store software. When downloading and installing our Game, Apple collects and processes the following data: device identifiers, IP addresses, and location information and it cannot be ruled out that Apple also transmits the information collected to a server in a third country.

 

Apple may also collect information from and about the device(s) you use to access our Game, including hardware and software information such as IP address, device ID and type, device-specific and app settings and properties, APP crashes, advertising IDs information about your wireless and mobile network connection such as your service provider and signal strength; information about device sensors such as accelerometer, gyroscope, and compass when you are using our Game. We cannot influence which Personal Information Apple processes with your registration and the provision of downloads in the respective App store and App store software. The responsible party in this respect is Apple.

 

Purchases

When you make In-app purchases, we (Apple on our behalf) may collect the following data from you to process the purchase:

 

  • Apple user ID

  • Email address

  • Payment confirmation from the payment data collected by Apple; and

  • Device IP and device serial number to link the story history to the device.

 

Unity

Our Game is built using the game development platform Unity. This uses software modules and libraries that come from Unity Technologies itself or third parties and become an inherent part of our Game (called a game engine). During the execution of the Game, Personal Information may be processed by Unity itself, including device identification numbers (so-called UDID - unique device identifiers, IP address). Data such as the device type, country of app installation, advertising ID, sensor markings (e.g., from the pressure or acceleration sensor), game identification number (app ID) and the checksum of the transmitted data are also processed.

 

Using Unity also means that the services are using "Unity Analytics" and "Unity Ads". Unity Analytics and Unity Ads collect the Personal Information such as IP addresses and device identification number (so-called UDID - unique device identifiers). Other data collected includes device specifications (device type, device language), usage data, information about in-app behavior. Through Unity Analytics and Unity Ads, we can find out which app ads are tapped or clicked on from your device, which of advertisement was watched and whether you download and use the advertised apps.

General Principles

a)     Security

We regularly monitor our systems for possible vulnerabilities and attacks and regularly review our information collection, storage, and processing practices to update our physical, technical, and organizational security measures.

 

Further, internet-based data transmissions can always have security gaps, so that absolute protection cannot be guaranteed. And databases or data sets that include Personal Information may be breached inadvertently or through wrongful intrusion.

 

Upon becoming aware of a data breach, we will notify all affected individuals whose Personal Information may have been compromised, and the notice will be accompanied by a description of the action being taken to reconcile any damage as a result of the data breach. Notices will be provided as expeditiously as possible after which the breach was discovered.

 

b)     Retention and Storage

We will retain your Personal Information as necessary in connection with the purposes described above and in accordance with Illinois statutory retention periods and other applicable laws, if so required.

 

c)     Minors

Persons under the age of 13 should not transmit any Personal Information to us without the consent of their parents or legal guardians. We do not request Personal Information from minors and children and do not knowingly collect such data or pass it on to third parties.

 

d)     Automated decision-making

Automated decision-making including profiling does not take place.

 

e)     Do Not Sell

We do not sell your Personal Information.

 

f)      Special Category Data

Unless specifically provided to us, we do not process Special Category Data.

 

g)     International Transfer

We do not transfer your Personal Information to countries outside the USA. However, and in the unlikely event we need to, we will always make sure to provide adequate protection including contractual arrangements and all reasonable technical and organizational measures.

 

h)     Sharing and Disclosure

We will not disclose or otherwise distribute your Personal Information to third parties unless this is a) necessary for the performance of our services, b) you have consented to the disclosure, c) or if we are legally obliged to do so e.g., by court order or if this is necessary to support criminal or legal investigations or other legal investigations or proceedings or to fulfill our legitimate interests.

 

i)      Obligation to provide Personal Information

You are not obliged to provide us with Personal Information. However, depending on the individual case as described above, you may provide certain Personal Information to us. If you do not provide us with this Personal Information, we may not be able to provide the requested service.

 

Your Rights and Privileges

a)     Privacy rights

You can exercise the following rights:

  • Right to rectification

  • Right to object to processing

  • Right to deletion

  • Right to data portability

  • Right of objection

  • Right to withdraw consent

  • Right to complain to a supervisory authority

  • Right not to be subject to a decision based solely on automated processing.

b)     Updating your information

If you believe that the information, we hold about you is inaccurate or that we are no longer entitled to use it and want to request its rectification, deletion, or object to its processing, please do so by contacting us.

 

c)     Withdrawing your consent

You can revoke consents you have given at any time by contacting us. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

 

d)     Access Request

In the event that you wish to make a Data Subject Access Request, you may inform us in writing of the same. We will respond to requests regarding access and correction as soon as reasonably possible. Should we not be able to respond to your request within thirty (30) days after receiving your request, we will let you know in writing within thirty (30). If we are unable to comply with your request, we will tell you why (except where we are not required to do so under the respective legal regulations mentioned above).

 

e)     Complaint to a supervisory authority

You have the right to complain about our processing of Personal Information to a supervisory authority responsible for data protection.

 

Changes

We may update this Privacy Policy from time to time. If we make changes to this Privacy Policy or materially change our use of your Personal Information, we will revise the Privacy Policy accordingly and also change the effective date at the end of this section. We encourage you to periodically review this Privacy Policy to be informed of how we use and protect your Personal Information.
